Immigration Bail



If you or a family member is being detained under immigration powers in an Immigration Removal Centre, detention centre or prison, you may be able to apply for Immigration Bail and request release while your immigration case or removal arrangements remain ongoing.

Immigration Bail may be granted by the Home Office or the First-tier Tribunal. The outcome will depend on the individual circumstances of the case, including the length of detention, immigration and criminal history, risk of absconding or reoffending, previous compliance with bail conditions, availability of suitable accommodation and whether there is a Financial Condition Supporter.

🎯 Possible Bail Conditions

A person granted Immigration Bail will normally be required to comply with one or more conditions, which may include:

  • Living at a specified address
  • Reporting regularly to the Home Office or another designated authority
  • Complying with electronic monitoring requirements
  • Observing restrictions relating to work, study or other activities
  • Attending appointments, hearings or other immigration procedures
  • Complying with a financial condition supported by a Financial Condition Supporter

Failure to comply with bail conditions may result in the conditions being varied, the person being detained again, or the Financial Condition Supporter being required to pay the amount they have promised.


‼️ Important Information

A grant of Immigration Bail allows a person to leave detention subject to specified conditions. It does not grant immigration permission, resolve the person’s immigration case or automatically provide the right to work in the United Kingdom. Any asylum, appeal, removal or deportation proceedings may continue after release.

If a bail application has been refused by the First-tier Tribunal within the previous 28 days, a further hearing will normally only be arranged if there has been a significant change in circumstances. Careful preparation of the proposed address, supporting evidence, Financial Condition Supporters and explanations addressing any alleged risks is therefore extremely important.
